Eviction law just changed again last week due to a Pennsylvania Supreme Court ruling. This time, they modified some of the timeline rules for when a property owner can regain possession after an eviction of a tenant.
The new law states that a landlord must wait at least 10 days (but not more than 120 days) to file a ‘Request for Order of Possession of the Property”. This request simplified means the landlord can actually have the tenant removed from the rental.
With COVID-19, it was considered extending the 120 day deadline, but the court decided against this. Instead, the court approved that a landlord is able to request up to tow extensions to the Request for Order of Possession of the Property each giving an additional 60 days. This is allowed as long as the landlord requests the first extension before the 180-day period expires.
Eviction is always viewed as a last resort and many landlords are willing to try and work a deal with tenants to avoid that. With this changes, landlords now have the option of working with tenants for up to 300 days.
